Jaime Mantilla Compte is a partner at Falconi Puig Abogados and is head of the Data Protection Department. With more than 15 years of experience, he concentrates his practice on intellectual property, data protection, privacy and advertising law, including mediation, arbitration, civil and commercial lawsuits.

He provides full and comprehensive advice to his clients on all matters related to the exercise, protection, contracting and litigation of intellectual property rights, especially trademarks, patents, copyrights, designations of origin and domain names. He also provides personalized support to his clients to ensure they comply with legal obligations and requirements in advertising, regulatory, consumer protection and data protection matters. He has acted as a consultant to domestic and foreign companies in a wide range of industries including food, drink, footwear, cosmetics, telecommunications and banking.

In the regulatory field, Jaime has taken part in technical meetings of the Ecuadorian Institute for Standardization (INEN) in relation to the study and adoption of technical and regulatory standards for the drinks industry in the country.

In addition, as head of Data Protection at the firm, Jaime has actively participated in the process of discussing and approving the Data Protection Law since its inception and is currently collaborating on establishing technical and legal criteria for the  Regulation that is currently being drafted.

  • He provided assistance, with favorable results, to the major educational center from Ecuador, in defending its rights to its trading name against an attempt to register extremely similar trademarks by a foreign entity. As a result, his client’s exclusivity rights were confirmed and additional registrations were made in its name.
  • Using out-of-court negotiation, he achieved the change of name and logo of a store in the city of Quito that displayed major similarities with a foreign well-known trademark and its corporate image.
  • He advised a hotel group on fulfilling the necessary formalities for its software developments and obtaining adequate protection of its copyrights over such software, as well as its trademarks.
  • He provided CINCHONA TREE DRINKS CHTD S.A. with guidance on protecting its intellectual property rights and obtaining trademark registrations in both Ecuador and the European Union, with a view to extending this protection to other countries.
  • Has guided a local beverage startup in the protection of its intellectual property rights, obtaining trademark registrations in Ecuador and the European Union and with perspectives to extend to other countries.
  • As a member of the Ecuadorian Data Protection Association and Chair of the Intellectual Property Committee of the Ecuadorian-American Chamber of Commerce, he participated actively in the approval process for the Organic Law on Personal Data Protection from initial presentation of the draft law in 2019 to its publication in May 2021. He has also provided consultancy to several domestic and foreign companies on how to develop and/or adapt their privacy and data management policies in accordance with this law.
